Terms of Service

The rules governing use of the QbiTrack platform. Operated by Qbit Cloud IT, Bangladesh.

Effective Date: June 12, 2026.

1. Introduction

Welcome to QbiTrack. These Terms of Service ("Terms") govern your access to and use of QbiTrack services, websites, software, applications, infrastructure, support services, and related technologies operated by Qbit Cloud IT ("QbiTrack," "Qbit Cloud IT," "we," "our," or "us").

By accessing, registering for, purchasing, or using any QbiTrack service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

2. About QbiTrack

QbiTrack is a server-side tracking and event processing platform that provides services including, but not limited to:

  • Meta Conversions API (Facebook CAPI) implementation
  • TikTok Events API implementation
  • Server-Side Google Tag Manager (sGTM) hosting
  • Event routing and tracking infrastructure
  • Conversion tracking optimization
  • Analytics and measurement infrastructure
  • Managed server-side tracking services
  • Related technical support and consulting services

QbiTrack is a service operated by Qbit Cloud IT.

3. Eligibility

You may use the Services only if:

  • You are at least 18 years old.
  • You have the legal authority to enter into binding agreements.
  • Your use of the Services complies with applicable laws and regulations.
  • You are not prohibited from receiving services under applicable laws.

If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

4. Account Registration

To access certain Services, you may be required to create an account. You agree to:

  • Provide accurate information.
  • Maintain current account information.
  • Protect account credentials.
  • Restrict unauthorized access to your account.
  • Notify us immediately of any security breach or unauthorized use.

You are responsible for all activities occurring under your account.

5. Subscription Services

Certain QbiTrack services are provided on a subscription basis. By purchasing a subscription, you agree that:

  • Fees are charged according to the selected plan.
  • Subscription fees may be billed monthly, annually, or according to custom agreements.
  • Services may automatically renew unless cancelled.
  • You are responsible for maintaining valid payment information.
  • Failure to pay may result in service suspension or termination.

We reserve the right to modify pricing, plans, or service features with reasonable notice.

6. Customer Responsibilities

You are solely responsible for:

  • Your websites and applications.
  • Data transmitted through QbiTrack.
  • Compliance with applicable laws.
  • Obtaining required user consent.
  • Maintaining privacy notices.
  • Managing your advertising platform accounts.
  • Ensuring the accuracy of tracking configurations.

You acknowledge that QbiTrack provides technical infrastructure and does not determine the legality of your data collection practices.

7. Data Protection and Privacy Compliance

Customers remain responsible for ensuring compliance with: GDPR, UK GDPR, CCPA, CPRA, ePrivacy regulations, applicable privacy laws, and advertising platform requirements.

Before transmitting personal data through QbiTrack services, Customers must ensure that they possess all necessary legal rights, permissions, notices, and consents.

QbiTrack does not provide legal advice and does not guarantee regulatory compliance for any Customer implementation.

8. Acceptable Use

You agree not to use the Services:

  • For unlawful activities.
  • To violate privacy rights.
  • To distribute malware or harmful code.
  • To conduct fraudulent activities.
  • To engage in unauthorized tracking.
  • To transmit illegal content.
  • To interfere with system operations.
  • To bypass security controls.
  • To gain unauthorized access to systems.
  • To abuse service resources.

Any use that negatively impacts service stability, security, or availability may result in immediate suspension.

9. Prohibited Activities

You may not:

  • Reverse engineer our platform.
  • Copy proprietary technology.
  • Resell services without authorization.
  • Use automated systems to abuse resources.
  • Attempt unauthorized access to infrastructure.
  • Circumvent billing systems.
  • Create multiple accounts for abusive purposes.
  • Use the Services in connection with illegal products or services.
  • Conduct activities that may damage our reputation or infrastructure.

10. Third-Party Platforms

QbiTrack integrates with third-party platforms, including but not limited to: Meta Platforms, Facebook, Instagram, TikTok, Google, Google Tag Manager, Google Analytics, and cloud hosting providers.

We do not control these platforms and are not responsible for their availability, policy changes, API limitations, service interruptions, account restrictions, or platform decisions.

Your use of third-party services remains subject to their respective terms and policies.

11. Service Availability

We strive to provide reliable services; however, we do not guarantee uninterrupted availability. Services may be temporarily unavailable due to: scheduled maintenance, emergency maintenance, infrastructure failures, third-party outages, security incidents, internet disruptions, or force majeure events.

Service availability commitments, if any, may be governed by a separate Service Level Agreement (SLA).

12. Fair Usage

QbiTrack services are intended for reasonable and legitimate business use. We may monitor resource consumption including event volume, bandwidth usage, API requests, storage consumption, and processing load.

If usage significantly exceeds normal operational limits or negatively impacts platform performance, we may request usage adjustments, recommend plan upgrades, apply usage restrictions, or suspend affected services.

13. Intellectual Property

All rights, title, and interest in QbiTrack Services, including software, infrastructure, documentation, trademarks, branding, and related materials, remain the exclusive property of Qbit Cloud IT or its licensors.

These Terms do not transfer ownership of any intellectual property rights. You receive only a limited, revocable, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

14. Customer Content

You retain ownership of data, content, and information submitted through your use of the Services.

You grant QbiTrack a limited right to process such information solely as necessary to deliver Services, maintain infrastructure, provide support, improve service functionality, and comply with legal obligations.

You represent that you have all rights necessary to provide such content.

15. Confidentiality

Both parties agree to protect confidential information received during the course of the business relationship, including technical information, account information, business strategies, security details, and non-public operational information.

This obligation survives termination of the Services.

16. Suspension of Services

We may suspend access immediately if: payment obligations are overdue, security risks are detected, fraudulent activity is suspected, applicable laws require suspension, Terms are violated, or service abuse is identified.

Where practical, we will attempt to provide notice before suspension.

17. Termination

Either party may terminate the relationship in accordance with applicable subscription terms.

Upon termination: access to Services may cease, certain data may be deleted, outstanding fees remain payable, and surviving legal obligations remain effective.

We are not responsible for losses resulting from termination performed in accordance with these Terms.

18. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, QbiTrack disclaims all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee specific advertising results, revenue increases, conversion improvements, platform approval, or regulatory compliance outcomes.

19. Limitation of Liability

To the fullest extent permitted by law, Qbit Cloud IT, QbiTrack, its directors, employees, contractors, affiliates, and partners shall not be liable for indirect damages, consequential damages, lost profits, lost revenue, business interruption, loss of data, reputational damage, advertising account actions, or third-party platform restrictions.

Our total liability arising from any claim shall not exceed the amount paid by you to QbiTrack during the six (6) months preceding the event giving rise to the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless Qbit Cloud IT and QbiTrack from claims, damages, liabilities, losses, costs, and expenses arising from: your use of the Services, violation of these Terms, violation of applicable laws, infringement of third-party rights, or improper collection or processing of personal data.

21. Force Majeure

QbiTrack shall not be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, government actions, war, terrorism, cyberattacks, infrastructure failures, utility interruptions, internet disruptions, or labor disputes.

22. Changes to Services

We may modify, improve, suspend, or discontinue any aspect of the Services at any time. We will make reasonable efforts to provide notice for material changes when practical.

23. Changes to These Terms

We may update these Terms periodically. Updated Terms become effective upon publication unless otherwise stated. Continued use of the Services after updates constitutes acceptance of the revised Terms.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Bangladesh, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the jurisdiction of the competent courts of Bangladesh.

25. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

26. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any applicable service agreements, constitute the entire agreement between you and QbiTrack regarding the Services.
